Following an administrative investigation conducted by the Morgan County Sheriff’s Department, the officer who fired a shot that struck the left eye of Kristin Nicole Biggs has been cleared and returned to duty in December. He was within our policy, Sheriff Blaine Breshears said. We are glad to have him back on the force. The Davis County Attorney’s Office is still conducting a more in-depth investigation to determine if the use of force by the officer was justified. Following the outcome of that investigation assigned to Rick Westmoreland, the Morgan County Sheriff’s Office will release the name of the officer. Dash cam video of the shooting was posted on YouTube in December. According to Captain Kenneth R. Payne with the Davis County Sheriff’s Office, Colorado is in the process of extraditing Biggs, 41, of Whitewater, Colo. Colorado has a felony warrant for Bigg’s arrest for failure to comply with judicial orders. After the Nov. 25 high-speed chase through three counties, officers finally stopped Biggs in South Weber. She was listed in critical condition at an area hospital, but was booked into the Davis County Jail Dec. 1. Prosecutors charged Biggs with two counts of third-degree felony aggravated assault and one count of felony failure to respond to an officer signal to stop, along with several misdemeanors. Breshears said there hasn’t been an officer-involved shooting in Morgan in recent memory, and not within the past 15 years he has been part of the department.
