Morgan County offices were closed Friday when a federal judge ruled the state’s ban on same-sex marriage had been overturned. But Morgan County Attorney Jann Farris was watching the news with the rest of the state.

Morgan County offices were closed Friday when U.S. District Court Judge Robert J. Shelby ruled that the 2004 Utah State Constitutional amendment defining marriage as only a legal union between a man and a woman was unconstitutional. He ruled that the amendment violates due process and equal protection under the fourteenth amendment. Salt Lake County immediately began issuing licenses.

Scott Logan Gollaher is scheduled to appear before Judge Noel S. Hyde in a Morgan court room Wednesday on four counts of aggravated sexual abuse of a child, an additional 10 counts of sexual exploitation of a minor, and one count of sodomy on a child.
Gollaher, a registered sex offender, was constructing a new home in the Morgan area when reports of sexual abuse reached the Morgan County Sheriff’s Office.
On June 17, 2012, Morgan County Deputy Joseph Rohbock was called by a concerned mother whose 11-year-old daughter had been the victim of a sexual offense incident. The mother had allowed her daughter and her daughter’s cousin to go with a friend the previous day.  The three girls had traveled to Morgan to Scott Gollaher’s home at 246 E. Woods Creed Road in Morgan City.  While visiting the Morgan home, the young girl said she had been touched, spanked and continually fondled.  The visit involved a four-wheeler ride where Gollaher was the driver and the victim was his passenger in front.

Pioneer Day is the perfect time to pull out family books of remembrance and journals.  I did just that this past week.  It pulled me in and reminded me of grandparents who have been gone for many years.  Two hours later I had read many pages and reminisced about the time I spent with my grandmother before she died.  What I did not expect to find, although I knew my grandparents were both born in Morgan, was a history of Enterprise.  It was a surprising history to me. My grandmother, Martha Vera Mecham Ogden, recorded many of her memories and this  was among her writings.

In January 1862 An act of the Utah Territorial Legislative Assembly established/defined the boundary of Morgan County.  Morgan County was blessed with an abundance of natural resources.  The acreage also became an essential piece of real estate for services making their route to the west coast.   These included the telegraph, railroad and future utilities that would eventually traverse Weber Canyon.

Garth Day appeared before Judge Dee Benson on Tuesday for sentencing.  Judge Benson first invited Day’s attorney to speak.  Day’s attorney, Brad Smith spoke and requested that the court deviate from the recommended sentence.  He asserted that when Day came to him on August 27 of 2010 he was a “broken man…He had in effect sold his self respect and honor for money…I have watched him take difficult steps to restore his honor,” said Smith.  Smith asserted that Day had come forward voluntarily once he felt that discovery was imminent, but that he had revealed the full nature of his crimes beyond what was going to be immediately discovered, including a bank loan and a letter of credit of which the county was not yet aware.

It was a somber atmosphere in the courtroom as Garth Day entered with his attorney, Amy Hugie.  As U.S. Magistrate Judge Samuel Alba read each one of the six charges aloud to him, Day responded with a weak and barely audible whisper.  With each charge presented to the defendant, the judge confirmed that Day understood it and also , understood that the government is required to prove their case against him beyond a reasonable doubt.  Day was also informed that if he changed his plea to guilty, he would waive his rights to a trial and therefore relieve the government from having to prove their case.  In each case Day responded in the affirmative.
